What are the legal requirements for guardianship?

In Alaska, the legal requirements for guardianship are outlined in Title 13 of the Alaska Statutes. Generally speaking, a guardian must be over the age of eighteen, a resident of the state, and able to accept the responsibilities of guardianship. The guardian will take on both legal and physical responsibility for the care of the ward. Legal responsibility includes making financial and legal decisions on behalf of the ward. Physical responsibility includes making sure that the ward has adequate food and clothing, a safe and clean living environment, and that medical and other necessary services are provided. The court must review the proposed guardianship and make sure that it is in the best interest of the ward. The court will consider the wishes of the ward, as well as the financial and other resources of the prospective guardian. If the court finds that the proposed guardianship is in the best interest of the ward, the court will order the guardianship. The guardian must keep detailed records of expenditures on behalf of the ward, and must file an annual report with the court outlining the guardianship activities for the year. The guardian must also provide the court with notice of any changes to the ward’s living arrangements or other relevant information. Finally, the guardian must insure that the ward’s rights are respected and that the ward’s best interests are always a priority.
