How often is a guardianship review required?
In North Dakota, guardians are required to have guardianship reviews performed at least once a year. During the annual review, the court will review the guardian’s performance, the guardian’s financial management of the person’s estate, the guardian’s plans for the ward’s future, and the overall well-being of the ward. In addition to the annual review, the court may also require guardians to provide additional reports to the court in order to stay updated on the guardianship. This may occur if there are any changes in the guardian’s circumstances (such as if the guardian moves to another state), or if there are concerns raised about the guardian’s performance. It is important that the guardianship remain in the best interest of the ward, and so additional reviews may be required. The court may also require the guardian to appear before the court in person for a hearing. At this hearing, the court can assess the guardianship and decide whether to terminate, modify, or continue it. It is important for guardians to remember that they are responsible for making sure that a guardianship review is performed at least once a year. If the guardian fails to do so, the court may take action, which can range from a warning to removal of the guardian.
