What documents are required for a guardianship?

In North Dakota, a guardianship is a legal process that appoints an adult to make decisions for a minor or an adult who is incapacitated due to physical or mental limitations. The guardian is responsible for all aspects of caring for and managing the ward, including representing the ward in legal proceedings and financial matters. When seeking a guardianship, the potential guardian must file a petition in court and submit the necessary documents. These documents will vary depending on the county and type of guardianship being requested. Generally, however, the petitioner will need to provide documents such as identification for both the guardian and the ward, written consent from the ward, a criminal background check for the proposed guardian, financial information, and a letter from a healthcare provider to prove the petitioner has been diagnosed with a mental or physical disability. The court may also require additional documents, such as a copy of the ward’s birth certificate, proof of residency, a medical evaluation, a durable power of attorney, or a will. In addition, some counties require the guardian to submit an initial guardianship plan as part of the petition. The guardian must also be willing to complete additional paperwork and defend their plan to the court during a hearing. Once the petition is accepted and the documents are provided, the court will review the petitioner and make a ruling on the guardianship. If the court grants the guardianship, a formal appointment will be made and the guardian will assume responsibility of the ward.
