What is a guardianship of the minor?
A guardianship of the minor is a legal relationship established by the court in Ohio that grants an individual, known as the guardian, the legal authority to care for a minor child, also known as the ward. This guardianship is normally appointed when the child’s parents are unable or unwilling to care for the child. A guardianship of the minor gives the guardian decision-making power over the child’s care, including decisions about the child’s education, medical care, housing, and other needs. Guardianships can take one of two forms: a limited guardianship or a plenary guardianship. In a limited guardianship, the guardian has authority over specific areas of the child’s life, such as decisions about medical care or educational matters. A plenary guardianship gives the guardian the authority to make all decisions for the ward. In either case, it is the duty of a guardian to act in the best interest of the child. The guardian must also strive to provide a safe and healthy living environment for the child. This is done by managing the child’s finances, monitoring their physical and emotional health, and providing necessary emotional support. When the child reaches the age of majority, or 18, in Ohio, the guardianship is dissolved. The guardian is also required to submit an annual report to the court that outlines the progress of the ward. A guardianship of the minor is a serious legal relationship and must be taken seriously by the individual appointed guardian in order to provide the child with the best possible care and a stable, healthy life.
