Who can petition the court for a guardianship?

In Georgia, any person may petition the court for a guardianship. Generally, when a guardianship is requested, one or both of the parents of a minor or adult should petition the court. Depending on the type of guardianship, other people may also petition the court. In situations where the minor is over the age of 14, the minor can also petition the court. The court will give preference to a parent or the minor when deciding who should be appointed as guardian. Additionally, if a minor has assets, a conservator may be appointed by the court to manage their funds and property. The court may appoint any other adult as a guardian, including an aunt, uncle, grandparent, or friend of the minor. The court may also appoint a public guardian, which is typically a state appointed social worker. When a guardianship is needed for an adult that cannot manage their affairs, any person can petition the court for guardianship. In these situations, it is preferred that a family member is appointed as guardian. If no family members are available, or suitable, the court can appoint a public guardian. When selecting a guardian, the court will consider the best interests of the ward in their decision. The court will also consider whether the proposed guardian has the financial and emotional resources to meet the needs of the ward.
