Are there age restrictions for guardians?

Yes. In Kansas, guardianship law states that anyone over the age of 21 is allowed to serve as a guardian. This means that an adult who is below that age, such as a parent, would not be allowed legally to serve as a guardian. The court system reserves the right to make exceptions to this rule, but only if there is a valid reason and they find that appointing a guardian who is younger than 21 would be in the best interest of the ward. A ward is the term used to describe a minor (under the age of 18) or an incapacitated adult for whom a guardian is appointed. In the case of a minor, the guardian must be of legal age. This means that if a minor’s parent is not yet 21, they must have another adult serve as the guardian. The court may also appoint a guardian ad litem which is an adult who is appointed by the court to represent the interests of the minor in court proceedings. In the case of an incapacitated adult, the court will look at the factors in the situation and decide if appointing a guardian who is younger than 21 is the best option.
