How can a guardian be removed from their position?
In Washington, a guardian may be removed from their position if they are found to be unsuitable for the role. This can occur if the guardian is found to be incapable of properly carrying out their duties, is found to be using their position to gain an advantage for themselves, or is no longer able to adequately provide for the ward’s needs. This may happen if a guardian is found to be physically or mentally impaired, or is found to be unsuitable in regards to their moral character. The law also allows for removal due to a number of other factors such as mismanagement of the wards’ assets, neglect of their care and/or upbringing, or if they are found to be using their guardianship for their own profit. The court may also decide to remove a guardian in cases of fraud or in the case of a guardianship dispute. If the guardian is removed, an alternate guardian will be appointed by the court. If the ward is suitable, they may also nominate another person to serve as guardian in their place. At the court’s discretion, an investigation may be conducted to determine whether a guardianship should be revoked or suspended. The court can also order an examination into the financial assets of a guardian in order to determine whether they are using their position of guardianship for their own benefit. Ultimately, the court must decide whether or not removal is in the best interests of the ward.
