What is an emergency guardianship?

An emergency guardianship is a legal arrangement in Washington state that allows quick appointment of a guardian for an individual in need of urgent protection. This often applies to individuals who do not have an existing guardian, such as a vulnerable adult, child, or incapacitated person. In Washington, an emergency guardianship can be ordered to meet the immediate physical safety needs of a person when it is determined there is no alternative. This could include a person who is a victim of abuse, neglect, exploitation, or exploitation. The emergency guardian will have the authority to manage the person’s personal and financial affairs. The emergency guardianship is temporary and only lasts for ninety (90) days, unless extended by the court for good cause. During this period, the emergency guardian is required to file a status report with the court along with a plan of action to protect the person at risk. The court must hold a hearing before the emergency guardianship ends and decide whether the guardianship should be continued, or whether the guardianship should be terminated. In making this decision, the court will consider the best interests of the person in need of protection. If the emergency guardianship is to be continued, the court will appoint a permanent guardian and name the duties associated with that guardianship.
