How is a guardian's performance evaluated?
In Washington, guardianship is evaluated by a court. The court will evaluate the guardian’s performance to make sure the ward’s best interests are being served. The court will look at a variety of factors such as the guardian’s ability to adequately manage the ward’s finances, provide reasonable care and protection, and maintain a suitable living environment. The court may also determine if the guardian has made necessary arrangements to ensure the ward has access to proper health care and maintains appropriate living standards. Additionally, the court may ask for the guardian’s records to determine if the guardian has been diligent in carrying out their duties. The court can take action if the guardian’s performance is found to be inadequate. Depending on the severity of the situation, the court may require the guardian to make changes, replace the guardian with another individual, or revoke the guardianship altogether. Any action taken by the court must be in the best interests of the ward. In Washington, the court does not require annual evaluations of the guardian’s performance. However, guardians can be evaluated at any time if the court or another party has reason to believe the guardian is not meeting the ward’s needs. This can occur if there is a complaint about the guardian’s performance, or if a family member requests an evaluation of the guardian.
