Who is eligible for guardianship?
In Texas, any adult, typically over the age of 18, can become a guardian. The person seeking guardianship must be a resident of Texas and must be able to demonstrate “good moral character” and “good business practices”. If the individual is under 18, their parent or a guardian may make the request. In order to be eligible for guardianship, the individual must show the need for care or supervision. Those who cannot provide for their physical or mental health, safety, and well-being due to disabilities, age, or other factors may be eligible for guardianship. It may also be necessary if there is no authorized person or organization available to provide supervision and care for the individual. The court may also consider whether the individual is financially stable, able to manage assets, and have the ability to make sound decisions. In addition, the court may ask for verification of the individual’s need for guardianship from a physician or psychologist. The court will make a decision based on the best interests of the individual and must be made within 60 days of the guardianship request. It is important to note that guardianship can be a lengthy and expensive process. Therefore, it is important to consult an experienced professional to ensure that all of the necessary criteria is met and that the individual’s rights are protected.
