What is involved in establishing a guardianship?

In Arkansas, establishing a guardianship involves a few steps that must be followed. First, a Petition for Appointment of Guardian must be filed with the court of the county where the person needing a guardian resides. The Petition must include information about the person, such as their name, age, address, and the reason for needing the guardianship. The Petition must also include the proposed guardian’s name, address, and relationship to the person needing the guardianship. Next, the court must appoint a guardian ad litem who is responsible for investigating the facts of the case and representing the best interests of the person needing the guardianship. The guardian ad litem will interview all parties involved and investigate any claims made in the petition. After the investigation is complete, a hearing will be held in court to determine whether a guardianship is needed. During the hearing, witnesses may be called to testify regarding the need for a guardianship and the suitability of the proposed guardian. After hearing all the evidence, the court will then make a decision on whether or not to grant the guardianship. If the court grants the guardianship, the proposed guardian must take a court-approved guardianship training class. This class will provide information on the legal responsibilities of a guardian. Once completed, the court will issue formal guardianship documents, which will outline the rights and responsibilities of the guardian. These documents must be filed with the court. If a guardianship is approved, the guardian’s rights and obligations will last until the guardianship is terminated.
