What is an informal guardianship?

An informal guardianship is a guardianship arrangement in Arkansas that is not supervised by a court. It allows one person to become the legal guardian of another person without having to go through the court system. This type of guardianship is usually used when the guardianship arrangement is for a short period of time and it does not involve significant decision-making or financial responsibility. In Arkansas, an informal guardianship agreement must be in writing and signed by both the person becoming the guardian and the person they are guardian for, and there must be two witnesses to the signing. The agreement should also include the duties and responsibilities of the guardian and the rights and obligations of the person being cared for. An informal guardianship agreement may be terminated at any time if either the guardian or the person being cared for decides to end the arrangement. The agreement may also be terminated in cases where the guardianship is no longer necessary or when the person being cared for reaches the age of majority. Informal guardianship agreements can be very helpful when a person is in need of temporary guardianship or when the guardianship arrangement is for a short period of time. However, it is important to note that informal guardianships do not give the guardian the same legal authority as a court-supervised guardianship, so guardians should always seek legal advice and assistance to ensure that their rights and responsibilities are properly represented.
