What is the law on organ donation?

In Washington, organ donation is governed by the Revised Code of Washington (RCW). According to the law, any adult who is 18 or older may donate organs, tissues and eyes–provided they have given informed consent. This consent must have been given in writing and witnessed by two people who are not related to the donor. The donor must also be of sound mind and not under the influence of a controlled substance at the time of the donation. There are special provisions for donors who are under 18 years of age; they must have permission from their parents, legal guardians, or another legally-authorized person in order to donate. Organ donation is a voluntary act, and a donor can choose to revoke it at any time. Revocation must be in writing, witnessed and include explicit instructions about the revocation. In addition, the donor’s family members, who are legally authorized to make medical decisions on their behalf, have the ultimate authority to withdraw an individual’s consent to donate organs. Organ donation is a generous and noble act, and the law in Washington is designed to ensure that the donor’s rights and wishes are respected. It is important that individuals considering organ donation in Washington understand the legal requirements and their rights as a donor.
