What is a Homeowners Association (HOA)?
A Homeowners Association (HOA) is a legal organization in Texas, formed to manage the common areas and amenities of a residential community. An HOA typically includes members of the homeowners in the area and may also be managed by a professional management company. The purpose of the HOA is to ensure that the residential community is well maintained and that the rules and regulations of the community are followed. The HOA has authority to enforce rules and regulations that are established in the HOA’s documents, such as a declaration of covenants, conditions, and restrictions (CC&Rs). Some of the common rules enforced by an HOA include restrictions on the types of property improvements, noise, and pet ownership. An HOA also has the authority to set assessment fees, such as monthly or annual dues, to fund the maintenance of common areas and amenities of the residential community. These fees and assessments are legally enforceable; if they are not paid the homeowners may be subject to fines, late fees, or even have a lien placed on their property. The HOA also enforces the rules and regulations of the residential community. This means that if a homeowner violates the HOA’s rules, they may be subject to fines, or even have their rights to use the common areas and amenities revoked. It is important for homeowners living in an HOA to familiarize themselves with the HOA documents and the authority of the HOA.
