What is a Homeowners Association (HOA)?
A Homeowners Association (HOA) is a legal entity that operates in certain communities and oversees certain rules and regulations that residents must abide by. The HOA is typically focused on maintaining a certain aesthetic or upholding certain standards that residents must meet in order to maintain the value of the community. HOAs are common in towns, cities, and neighborhoods where there are multiple properties of similar use or value. In Washington, HOAs are created in the form of a non-profit corporation. This includes filing with the Washington Secretary of State’s office. The bylaws will also be created in order to create the framework for the HOA. This includes the purpose of the HOA, the board of directors, membership duties, voting procedures, and other rules. Once established, the HOA works to ensure that the rules and regulations of the community are upheld. This includes, but is not limited to, maintenance of all common areas and roads, enforcement of parking regulations, and the enforcement of any deed restrictions or architectural control guidelines. The HOA also collects dues from members, which is then used for administrative fees, landscaping, and other needs that the HOA has identified. Overall, a Homeowners Association is a legal entity that helps ensure the rules and regulations of a specific community are upheld. This ensures that all residents are in compliance and that the value of the community is maintained.
