Can the HOA deny my request for an architectural modification?
In Virginia, a Homeowner’s Association (HOA) can deny a homeowner’s request for an architectural modification if it violates the HOA’s governing documents. The HOA’s governing documents, which are drafted by the HOA’s Board of Directors, determine what features and modifications are allowed on the property. Typically, these documents include HOA-prescribed rules and restrictions, such as those governing the installation of fences, sheds, and changes to the exterior of the home. Therefore, the Board of Directors can deny requests that contravene these rules. In addition, the HOA can deny architectural modifications if they are not in compliance with local building codes and regulations. Property owners must also obtain approval from the zoning department before making modifications to their homes. If the requested modification does not comply with these rules, then the HOA can deny the request. Finally, the HOA may also deny a request for architectural modifications if they are deemed to detract from the aesthetic quality of the neighborhood. The Board of Directors may consider how the modification will blend in with the existing structure of the home and the general appearance of the neighborhood. Ultimately, the HOA has the discretion to approve or deny requests for architectural modifications.
