How do I file a complaint against my HOA?
To file a complaint against your Homeowners Association (HOA) in Texas, you must first understand the process and the laws that apply to your situation. First, collect evidence and information supporting your complaint. This should include, at a minimum, the HOA’s governing documents and any correspondence between you and the HOA. Once you have assembled all of your evidence, there are several methods you can use to resolve the dispute without getting into a lengthy court case. You can contact the HOA directly and request a resolution. If that does not work, you also can file a formal complaint with the state agency that oversees homeowners associations, commonly referred to as the Texas Real Estate Commission (TREC). To file the complaint, you must complete an Official Complaint Form, describing the particulars of the dispute in detail. You also must provide the TREC with supporting evidence. You can submit the form electronically, or via mail. In most cases, the HOA will be required to respond to the complaint. If the HOA does not respond, it could be subject to fines and other remedies. The TREC may review the HOA’s response and make a decision regarding the complaint. If the TREC is unable to resolve the dispute, you may have to pursue other avenues of recourse, such as small claims court. However, this should always be a last resort. The best practice is to attempt to resolve the dispute through the TREC before taking any legal action.
