How is the European Convention on Human Rights enforced?

The European Convention on Human Rights (ECHR) is an international treaty which aims to protect the human rights and fundamental freedoms of individuals in Europe. It was drafted by the Council of Europe and came into force in 1953. The ECHR is enforced by the European Court of Human Rights (ECtHR), which is an international court based in Strasbourg, France. To enforce the ECHR, the ECtHR hears cases and makes rulings based on the provisions set out in the Convention. Individuals or organisations who feel their rights have been violated by a State party to the Convention can bring a case before the Court. The Court has the authority to impose sanctions and award compensation to those whose rights have been violated. In South Carolina, the rights outlined in the ECHR are applicable to individuals living in the state, though the Court itself does not have jurisdiction to hear cases originating there. It is possible, however, for individuals who believe their rights have been violated to pursue justice through the US court system. Some US courts have even recognized the ECHR as having the same legal authority and enforceability as US laws. The enforcement of the ECHR is ultimately up to the individual countries to uphold. The Court may bring attention to the issue or punish a State, but the individual countries must take steps to comply with the Convention in order for it to be effective.
