What are the rights of persons with disabilities?
In North Carolina, persons with disabilities are afforded various rights under local, state, and federal law. The Americans with Disabilities Act (ADA) prohibits discrimination against individuals with disabilities in areas of public access, private employment, and through the provision of public services and accommodations. According to the ADA, persons with disabilities are also entitled to reasonable accommodations to carry out tasks and activities. At the state level, North Carolina has enacted the North Carolina Persons with Disabilities Protection Act (NCPDPA), which provides additional protections for persons with disabilities. Under the NCPDPA, persons with disabilities are guaranteed full and equal access to public accommodations and services. This law prohibits the denial of services or access to persons with disabilities, and holds businesses and other entities responsible for providing reasonable accommodations for these individuals. The Rights of Persons with Disabilities Act also provides protections to persons with disabilities. This law ensures that persons with disabilities have the right to engage in meaningful activities, receive adequate medical care and educational services, receive accommodations in public places, and be free from discrimination and abuse. Finally, the North Carolina State Constitution also guarantees rights to persons with disabilities. This includes the right to equal and substantial access to court proceedings and the right to vote. The Constitution also guarantees disability rights such as the right to receive protection from physical and mental suffering, the right to receive humane treatment when receiving medical services, and the right to receive appropriate assistance with living and employment.
