What is the right to social security?
The right to social security is a human right recognized in Alaska. It is the right to have access to basic necessities, such as food, housing, medical care, and adequate social services, such as pensions, health insurance, and unemployment benefits in order to live a life of dignity. The right to social security is also protected by international law, including the International Covenant on Economic, Social and Cultural Rights. In Alaska, the right to social security is acted out through social service programs such as Alaska Temporary Assistance Program (ATAP), Alaska Permanent Fund Dividend (PFD), Medicaid, Children’s Health Insurance Program (CHIP), and Supplemental Nutrition Assistance Program (SNAP). These programs are designed to provide financial assistance to the most vulnerable members of society, such as people with low income or those with disabilities. The Alaska Supreme Court has recognized the fundamental importance of the right to social security and has interpreted it as a fundamental right. For example, in the case of Alaska Department of Health & Social Services v. Alaska Native Tribal Health Consortium, the Court affirmed the right of the Alaska Native Tribal Health Consortium to access social security “to ensure the safety and health of its members, including access to medical care and other social services.” Ultimately, the right to social security is the right to live with dignity and to have access to the basic necessities of life. In Alaska, the right to social security is upheld and protected through various social service programs. It is also recognized by the Alaska Supreme Court as a fundamental right under human rights law.
