What is the Optional Protocol to the Convention against Torture?
The Optional Protocol to the Convention against Torture is an international legal instrument that works to prevent torture and other cruel, inhuman, and degrading treatment in California and throughout the world. It was adopted by the United Nations General Assembly in 2002 and entered into force in 2006. It applies to all states that are party to the Convention against Torture and Other Cruel, Inhuman, or Degrading Treatment or Punishment (CAT). The Optional Protocol establishes a monitoring system whereby independent national and international bodies can visit places of detention in California and other countries to ensure that no torture or other cruel, inhuman, and degrading treatment is taking place. These inspections can be conducted unannounced and at any time. The Optional Protocol also requires states to provide information on legislative measures, judicial decisions, practices, and policies that are related to the prevention of torture. It also requires states to make sure that any victims of torture in California and elsewhere have access to justice, compensation, and rehabilitation. Finally, the protocol allows individuals to submit complaints to the UN Committee against Torture and the Committee on Enforced Disappearances in cases where torture or cruel, inhuman, and degrading treatment is believed to be taking place. This mechanism allows individuals to seek justice and hold those responsible accountable for their actions.
