How much money can I receive from a workers' compensation claim?
In Virginia, the amount of money a person can receive from a workers’ compensation claim depends on the nature of the injury. Generally, the amount of compensation a person can receive will depend on things such as how severe the injury is, how long the person must be off of work, and what their average weekly wage was prior to the injury. The Virginia Workers’ Compensation Act requires employers in the state to provide their employees with benefits if they suffer an industrial accident or illness. These benefits can include medical care, temporary total disability benefits, and permanent disability benefits. Medical Care: If an employee is injured on the job in Virginia, their employer must provide them with reasonable and necessary medical treatment for their injury. This includes hospitalization, medical treatment, and medications. Temporary Total Disability Benefits: If an employee is injured in a workplace accident and cannot work for more than three days, they can be eligible to receive temporary total disability benefits. These benefits are based on two-thirds of the employee’s average weekly wage prior to the injury and can be received for up to 500 weeks. Permanent Disability Benefits: If an employee’s injury results in permanent disability, they may be eligible to receive permanent disability benefits. Benefits are based on a percentage of the employee’s average weekly wage before the injury and the amount of disability that the employee has. For example, if an employee has a 50% disability, they would receive 50% of their average weekly wage before the injury. Ultimately, the amount of money a person can receive from a workers’ compensation claim in Virginia will depend on the severity of the injury and the wages the employee earned prior to the injury.
