What is a subrogation recovery?
Subrogation recovery is a legal process in Mississippi where an insurance company can act on behalf of their insured to recover money from a third-party for damages caused by the third-party’s negligence or wrongful action. In other words, when someone else is responsible for causing an injury to an insured, the insurer can use subrogation to try to get money from the responsible party to pay for the claim. Subrogation works by allowing the insurance company to “step into the shoes” of the insured and make a claim for the damages. This is done so that the insured does not have to go through the legal system to collect the money from the responsible party, which can be expensive and time consuming. Once the insurance company has recovered the money, they will put it towards the settlement of the claim. Subrogation applies in two situations: when an insurance company pays out for the insured’s medical expenses, damages, or other losses, and when an insurance company pays out to cover property damages. In both cases, the insurer is entitled to recover the amount paid from the party responsible. This process allows insurance companies to save money due to the lower legal costs associated with subrogation instead of taking the responsible party through the court system. It also streamlines the process and allows the insured to receive a settlement without having to go through the expense and hassle of a lawsuit.
