What is a securities fraud complaint?
A securities fraud complaint is a legal document that is filed by an individual or business against another individual or business. It is typically filed in the state of Washington when an investor believes they have been the victim of investment fraud. A securities fraud complaint is used to bring a case against the person or company which is alleged to have fraudulently induced an investment of money or securities. Generally, the complaint alleges that the defendant made false statements or omitted key information in order to persuade the investor to invest. Typically, a securities fraud complaint: describes the investment in detail; sets out the material facts relating to the fraud allegation; estimates the amount of money taken from the investor; documents any damages; and lists the relief sought by the investor. The Washington Department of Financial Institutions provides a template which outlines the information required in a securities fraud complaint. It is important to use the template as it includes specific details which must be included in the complaint in order for it to be valid. The complaint will be reviewed by the department, which could then refer it to the Washington Securities Commission. If the commission finds a violation has taken place, they may take regulatory action against the alleged offender. The commission may also attempt to mediate a settlement between the parties or seek criminal charges against the defendant.
