What are the eligibility requirements for asylum?

In Vermont, the eligibility requirements for asylum are outlined by the U.S. Citizenship and Immigration Services (USCIS). Generally, to be eligible for asylum you must demonstrate that you have suffered past persecution or have a reasonable fear of future persecution in your home country based on your race, religion, nationality, political opinion, or membership in a social group. Additionally, if you are applying for asylum due to your political opinion, you must also show a connection between your political opinion and the past persecution or fear of future persecution. In order to file for asylum, you must be physically present in the United States. You must also submit a completed Form I-589 Application for Asylum and for Withholding of Removal to the USCIS within one year of entering or arriving in the U.S., unless you can show good reason as to why you could not submit within the time limit. The USCIS will review the application to determine if you meet the eligibility requirements and to decide whether or not you should be granted asylum. If your application is approved, you will be granted temporary legal status in the United States. This status allows you to work and allows your spouse and/or minor children, who are in the U.S. at the same time, to also receive temporary legal status. If your asylum application is approved, you may be able to apply for green card status one year after the date you were granted asylum. After five years, you may be able to apply for U.S. citizenship. It is important to understand that the asylum process can be very complicated, and you should consult with an attorney or other qualified representative to help you understand the laws and regulations that may apply to you.
