How is asylum granted?

Asylum in North Dakota is a form of protection granted to people fleeing persecution in their own country. It is a humanitarian form of immigration relief that is available to refugees who have a well-founded fear of persecution in their home country due to their race, religion, nationality, political opinion, or membership in a particular social group. To be granted asylum, applicants must be able to demonstrate that they would face serious harm if they were to return to their home country. If they pass this interview, the application is then referred for a full merits hearing before an immigration judge. At this hearing, the applicant must present evidence that they meet the definition of a refugee and prove that they would face serious harm if they were to be returned to their home country. If the judge determines that the applicant has met all the requirements, they will then grant asylum.
