What happens if my asylum application is denied?

If your asylum application is denied in Tennessee, you may face deportation from the United States. The asylum processing system is complicated and denials are common. If your application is denied, you can appeal the decision in federal court. You may be able to appeal in either the U.S. Court of Appeals for the Sixth Circuit, which serves Tennessee, or the Board of Immigration Appeals. If you are denied asylum and do not appeal, you may be eligible to apply for withholding of removal, another form of immigration relief. Withholding of removal is similar to asylum, but the burden of proof is higher. You may also be eligible to apply for protection under the Convention Against Torture, which is a form of protection specifically for people who fear torture they would face if they were sent back to their home country. It is important to remember that you may be eligible for protection under the U.S. immigration laws even if your asylum application is denied. Therefore if you are facing the possibility of asylum denial, you should consult with a qualified immigration attorney to discuss your options. An experienced attorney will be able to advise you of the best course of action and help guide you through the process.
