What happens if my asylum application is denied?

If your asylum application is denied in Virginia, there are still some options available to you. Depending on your case, you may be eligible to appeal the decision, or to apply to the Board of Immigration Appeals (BIA). If you appeal, you must file an appeal with the U.S. Court of Appeals for the Fourth Circuit within 30 days of receiving the denial. You must also include a copy of the denial of your application and any other evidence you want the court to consider. The court may also order the Immigration Judge to provide a written explanation of the reasons why the application was denied. If your case is not eligible for appeal, you may still be able to apply for a stay of removal from the BIA. This is different from an appeal, as it does not ask the court to re-judge your case, but it asks the court to consider whether it is safe for you to remain in the country in the meantime. In addition, you may also be able to file a motion to reopen your asylum application with the BIA. This will allow you to present new evidence that was not available at the time of your initial application. Ultimately, it is important to ask an experienced immigration attorney about the best way to proceed after your asylum application has been denied. An attorney can assess the options available to you, and advise on the best course of action for your particular case.
