What are the limitations of asylum?

Under U.S. federal law, asylum is a form of protection granted to individuals who are already in, or arriving to, the United States and who are afraid of persecution based on their race, religion, nationality, political opinion, or membership in a particular social group. In South Carolina, those seeking asylum must apply within one year of arriving in the U.S. Asylum seekers must meet the definition of a “refugee”, meaning they must have experienced or have a “well-founded fear of persecution”. Asylum, however, does have limitations. After receiving asylum, individuals must wait one year before they can apply for permanent residence in the United States, and they must maintain asylum status for a minimum of four to five years before becoming eligible for permanent legal residence. Furthermore, asylum seekers can be denied entry to the United States if they have committed a crime, made a false statement, or engaged in fraudulent behavior in connection with their application. They may also be subject to removal if the grounds for their asylum are found to be invalid or if their application is found to have been filed after the statutory one-year filing deadline. Additionally, asylum seekers may be required to meet certain other qualifications for their application to be considered, such as demonstrating a well-founded fear of persecution based on their political opinion or membership in a particular social group. Overall, asylum is an important form of protection for individuals facing persecution, but its limitations should be taken into consideration by those seeking refuge in the United States.
