What is the “reinstatement of removal”?

The “reinstatement of removal” is a process which applies specifically to people who have had an order of removal issued by an immigration court. It is a way for the US government to deport a person even if they have already been previously deported. This process is only applicable to those who have had a previous order of removal, and not for those facing deportation for the first time. Specifically in South Carolina, an immigrant with an order of removal may be subject to reinstatement of removal. This would involve being taken into custody by the US Immigration and Customs Enforcement (ICE) and put in “Expedited Removal”. Expedited Removal involves a fast-track deportation process without having to appear before an immigration judge. In order to qualify for reinstatement of removal, the immigrant must have illegally re-entered the US after being previously deported from the US. If the immigrant is found to have re-entered for any other reason than requesting asylum or other forms of relief from the immigration court, then they could be subject to reinstatement of removal. Once the ICE has taken an immigrant into custody, they have the ability to reinstate a previously issued order of removal without having to refer the case to the immigration court. This process can occur quickly, often within days or weeks of the immigrant being taken into custody. For immigrants facing reinstatement of removal in South Carolina, there are limited forms of relief available. Generally, the best option is to seek assistance from a qualified immigration attorney. An attorney can review the individual case and determine what forms of relief may be available to the immigrant, in order to prevent the reinstatement of removal.
