What is removal/deportation?

Removal/deportation is a process where non-citizens of a country are removed from the country to their home country. This occurs when a non-citizen either violates the terms of his/her immigration status, or is subject to a removal order for reasons such as criminal convictions. In the United States, removal/deportation is governed by federal immigration law. In Ohio, removal/deportation is conducted by Immigration and Customs Enforcement (ICE), which is a federal agency responsible for identifying, detaining, and deporting people who are in violation of immigration laws. ICE also has the authority to administratively remove people who are determined to be ineligible for asylum, or whose presence in the U.S. is determined to be a threat to the public and/or national security. Once a person has been identified as subject to removal/deportation, they must first be detained by federal immigration officials. This can happen at a designated detention facility, or in the typical case, in the home or workplace of the person being detained. After the person has been detained, they are either offered the chance to voluntarily depart from the country or put before an immigration judge for removal proceedings. If the individual is denied asylum, they are placed in removal proceedings and may be subject to deportation.
