What is the definition of “refugee”?

In Tennessee, the definition of “refugee” is someone who is unable or unwilling to return to their country of origin due to a “well-founded fear” of persecution based on race, religion, nationality, political opinion, or membership in a particular social group. Refugee status is determined by the United States Citizenship and Immigration Services and can be granted to individuals fleeing countries where they may be at risk of harm, such as war, torture, or an oppressive regime. Individuals seeking refugee status in Tennessee must provide significant evidence of their claim, including proof of their identity, a detailed description of the events that led to their flight, and proof that their fear of persecution in their home country is “well-founded”. The individual must also demonstrate that they meet certain criteria, such as that they are not involved in or associated with criminal activities, and that they have not been complicit in acts of torture or persecution in their home country. In many cases, individuals can receive protection from the US government without seeking formal refugee status. This is known as asylum, which provides similar protections to refugees but is granted on a case-by-case basis. As with refugee status, individuals must provide evidence that they are facing a well-founded fear of persecution in order to be granted asylum. Tennessee’s immigration laws are designed to protect individuals seeking refuge from persecution in their home countries. While the exact criteria for refugee and asylum status may vary slightly depending on the situation, individuals must provide evidence of their identity, evidence of the events that led to their flight, and evidence that their fear of persecution is “well-founded” in order to be granted protection.
