What is an “asylum clock”?
An “asylum clock” is a term used to describe a period of time during which an applicant can remain in the U.S. while their asylum case is considered. This period is determined by U.S. immigration laws and the rules of procedure in Washington. During this time, applicants can stay in the U.S. as long as their case is pending with the courts. The “asylum clock” starts when the applicant files a Form I-589, which is the application for asylum. Once the clock starts, the applicant must wait 150 days for their case to be considered. This waiting period can be extended for certain reasons, including delays caused by the Immigration Judge, or if the applicant has to provide additional evidence. If the applicant is granted legal status, the applicant can remain in the U.S. until their case is ultimately resolved.
