What is the “defensive asylum application”?
The “defensive asylum application” is a term used in Washington state for the process in which a person applies for asylum with the U.S. Citizenship and Immigration Services (USCIS). It is a process available to those who have already been detained or are facing removal from the United States, and have reason to believe that they will be persecuted in their native country. A defensive asylum application must be submitted to the USCIS district office in Seattle, Washington, along with any supporting documents such as birth certificates, identification, letters, medical records, or evidence of past persecution. The USCIS will review the application to determine if the individual has a credible fear of persecution in their home country based on their race, religion, nationality, membership in a particular social group, or political opinion. If it is determined that the individual has a credible fear, a credible fear interview will be conducted. This is an in-depth questioning of the individual’s claim. If the individual passes the credible fear interview, their case will be referred to an asylum officer and a final decision will be made. If the individual is granted asylum, they will be allowed to remain in the United States lawfully, with all the rights and benefits of a legal immigrant. If their application is denied, they may appeal the decision and be able to reapply.
