What is a “withholding of removal”?
Withholding of removal is a form of relief available to non-citizens facing removal from the United States. It is a protection from removal similar to asylum, but with stricter standards that make it more difficult to qualify for this form of relief. Withholding of removal is available when an individual has suffered or has a fear of suffering persecution in their home country based on race, religion, nationality, political opinion, or membership in a particular social group. The individual must demonstrate that there is a clear probability of persecution or harm in their home country if they are returned. Withholding of removal provides the non-citizen with relief from being deported. However, it does not provide the individual with legal status in the United States or any other benefits. Additionally, withholding of removal does not allow individuals to become permanent residents, nor does it lead to citizenship in the U.S. A grant of withholding of removal is only effective while deportation proceedings are pending, but it can be re-filed each year. In New York, a person seeking relief from removal through withholding of removal must demonstrate that it is more likely than not that they will be persecuted or subjected to harm in their home country if they are removed. They must also demonstrate that they have suffered or fear they will suffer persecution based on one of the five protected characteristics.
