What is a “withholding of removal”?

A “withholding of removal” is a form of protection that the U.S. government offers to people who have already been granted asylum in the United States or who are eligible for such protection. This type of protection helps individuals avoid being removed from the United States to a country where they are likely to suffer persecution. A person might be eligible for withholding of removal if they can show that it is more likely than not that they would suffer persecution based on their race, religion, nationality, political opinion, or membership in a particular social group in their home country. In North Dakota, requests for withholding of removal are submitted to the United States Citizenship and Immigration Services (USCIS). It is a complex process that requires the submission of various forms and supporting documents, as well as a hearing before an immigration judge. The USCIS and the immigration judge will review the individual’s case and decide whether the person is eligible for withholding of removal. If withholding of removal is granted, the individual is allowed to remain in the United States, but is not granted legal permanent resident (LPR) or refugee status. They will be able to work and live in the United States, but may not travel outside of the country without special permission. Withholding of removal is almost always indefinite and can only be terminated if the individual voluntarily leaves the United States or no longer has a reasonable fear of persecution in their home country.
