What is a “withholding of removal”?

A “withholding of removal” is a form of immigration relief available to individuals to remain in the United States. Withholding of removal is similar to asylum; however, the difference between the two is that withholding of removal offers greater protection against being deported and provides access to work authorization. In the United States, a person may be eligible for withholding of removal if they can prove that their life or freedom would be threatened if they were to be deported. The applicant must show that they are subject to persecution based on their race, religion, nationality, membership in a particular social group, or political opinion. In South Carolina, applicants must submit a Form I-589, Application for Asylum and Withholding of Removal. Depending on the case, the applicant may also need to provide personal statements, letters from family members, or medical records to support their claim. The United States Citizenship and Immigration Services (USCIS) will review the application and determine whether the applicant is eligible for withholding of removal. If the applicant is approved, they will be allowed to remain in the United States and will have access to certain benefits, such as work authorization. Withholding of removal offers a valuable form of immigration relief for individuals in South Carolina. It allows those who are facing persecution to remain in the United States and provides them a chance to build a better life for themselves and their family.
