What is an “expedited removal”?

An expedited removal is an immigration procedure used by the U.S. government to quickly deport certain non-citizens. This fast-track removal is not the same as asylum, where non-citizens are allowed to remain in the country while their asylum application is processed. Expedited removal is typically used on non-citizens who have been in the U.S. less than two weeks and meet certain criteria, such as having no valid visa or entry documents. In the state of South Carolina, the Department of Homeland Security (DHS) has the authority to deport non-citizens using expedited removal procedures. In such cases, the DHS can order a person to be removed from the U.S. without an immigration court hearing. If a person is subject to an expedited removal order, they can contest the order by filing for asylum, which can ultimately lead to a reversal of the order. In South Carolina, the Immigration and Customs Enforcement (ICE) agency is responsible for executing expedited removal orders. In general, ICE officers must comply with the applicable laws and procedures of the state and federal government when carrying out an expedited removal. If you are facing an expedited removal, you should seek the advice of an experienced immigration attorney who can assist you in filing for asylum.
