What is an “affirmative asylum application”?
An affirmative asylum application is a process used by immigrants to ask for political asylum in the United States. This type of application is filed with the U.S. Citizenship and Immigration Services (USCIS) in Colorado and has to be done from inside the United States. In order to file for an affirmative asylum application, the immigrant must provide information about his or her identity, where they came from, and why they are seeking political asylum. They must also convince the USCIS that they have a “credible fear” of persecution in their home country due to their race, religion, nationality, political opinion, or membership in a particular social group. Once the affirmative asylum application is filed, the applicant will be asked to attend an interview with an asylum officer at a USCIS office. The officer will decide if the applicant has a reasonable fear of persecution and, if so, grant them asylum. It’s important to note that, if an immigrant makes an affirmative asylum application, they cannot be removed from the United States while their application is being processed. Furthermore, if the application is accepted, the immigrant may be eligible to work in the U.S. and eventually become a lawful permanent resident.
