What is a “withholding only” application?

A “withholding only” application is a type of application for relief from deportation that is filed in immigration court. The application is specifically used for individuals who are not eligible for asylum, but who may have a claim to remain in the United States nonetheless. The purpose of a withholding only application is to allow the individual to remain in the country legally, while also avoiding removal. In New York, an individual must meet certain criteria to be eligible for relief through a withholding only application. First, the individual must have a fear of returning to their country of origin due to persecution or torture, and this fear must be based on one of five protected characteristics: race, religion, nationality, political opinion, or membership in a particular social group. Additionally, the individual must be able to demonstrate that they are at risk of suffering serious harm or even death upon returning to their home country. If all of these criteria are met, the immigration court may grant the individual a withholding of removal, which essentially means that the court has decided that removal would be cruel and unusual punishment. Withholding of removal does not result in a green card or permit someone to become a permanent resident. Instead, it offers temporary protection from deportation, meaning that the individual must continue to apply for relief and renew their application when necessary in order to remain in the United States.
