What is a “withholding only” application?

A “withholding only” application is a term used to describe a form of relief from deportation that is available under certain scenarios. This type of relief is a last resort for those who are not eligible for any other forms of relief from deportation. If granted, a “withholding only” application will allow the person to remain in the United States on a temporary basis, meaning they will not face deportation. In Virginia, individuals who are facing deportation may apply for “withholding only” protection if they can prove that they will face serious harm if they are removed from the United States. To qualify, the applicant must provide evidence that they have suffered past persecution or have a reasonable fear of future persecution due to their race, nationality, religion, political opinion, or membership in a particular social group. Additionally, the individual must illustrate that they would suffer “exceptional and extremely unusual hardship” to their family members if removed from the United States. If the individual meets these requirements, they may be granted “withholding only” protection from deportation from Virginia. As it is a temporary form of relief, the individual may still be required to periodically report to immigration authorities. This form of relief also does not provide the individual with a path to permanent residency, nor does it provide the individual with the ability to work in the United States.
