What is the “asylum clock”?

The “asylum clock” is a term used to describe the amount of time an individual has to pursue an asylum application in the U.S. The U.S. immigration laws, in South Carolina and throughout the entire country, provide that asylum seekers must file their applications within one year of their last arrival into the United States. That is, an asylum seeker has one year to file their application from the day they entered the country for the last time. The “asylum clock” is not suspended, and all days count, even if the asylum seeker did not commit any form of immigration violation. Aside from certain limited exceptions or showing that there is changed country conditions, asylum seekers have only one year to pursue their asylum application in South Carolina or any other state. If an individual misses the one-year deadline, they may become ineligible for asylum status. Therefore, it is important to keep track of the asylum clock and ensure that it is met in order to pursue an asylum application in the U.S.
