What is an “asylum clock stop”?

An “asylum clock stop” is an immigration policy term used to describe the period of time during which an individual who has been granted asylum in the United States may not be required to apply for a green card. An asylum clock stop applies to individuals who are eligible for an asylum grant and who have been in the US for more than a year. Under immigration law, an individual who applies for asylum in the US must file a Form I-589 within one year of entering the country, otherwise their asylum application will be denied. When asylum is granted, the individual can then apply for a green card but is generally required to apply within a year. The “asylum clock stop” suspends the one-year deadline to apply for a green card while the individual is considered an asylee. This applies to individuals in Florida who are granted asylum by a federal immigration judge. Once the asylum clock stop is in effect, it will remain in effect until an individual either has their asylum status terminated or adjusts to become a lawful permanent resident. The asylum clock stop in Florida is used to give those who are granted asylum the time and support to adjust to their new life in the United States without having to rush the process of applying for a green card. It also allows the individual to receive certain government benefits and protection from deportation.
