What is an “asylum clock stop”?
An “asylum clock stop” in Virginia is a period of time during which a person’s period of continuous physical presence in the United States as part of their application for asylum will not be counted against them. This period of time can include up to one year prior to the filing of the asylum application and up to 12 months following the filing of the asylum application. During the asylum clock stop period, the individual’s application processing is paused and the time they have spent in the United States as part of their asylum application is not counted against the time limit of one year for filing a complete application. In this case, the person will not be able to use the asylum clock stop period to extend the filing deadline. Additionally, since the asylum clock stop period does not apply to those who have missed the filing deadline, this period of time cannot be used to restore a person’s eligibility for asylum. The asylum clock stop period was put in place to provide additional protections to individuals who are applying for asylum status and to help ensure that they have enough time to gather the necessary evidence to support their application for asylum. With this additional time, applicants are able to present a stronger case for their asylum claim and increase their chances of successful asylum status.
