What happens if I am found to have a “credible fear”?

If you are found to have a "credible fear" in New York, you may be eligible for asylum. This means that you are able to remain in the United States and are protected from being deported. The first step in the asylum process in New York is to have an immigration court determine whether you have a valid claim for asylum. This is done through an interview with an asylum officer who will assess your case. If the asylum officer decides that you have a credible fear, you will then be referred to an Immigration Judge. They will conduct further questioning and review evidence to determine if you have a valid claim to asylum. If the judge finds that you have a credible fear, they will grant you asylum in the United States. Once you have been granted asylum, you will be able to remain in the United States and will be eligible for certain benefits. These include the ability to work, access to health care, and the ability to attend school. You will also be protected from deportation and be allowed to apply for a green card. In order to maintain your asylum status, you must continue to demonstrate that you face persecution if you return to your country of origin. This means that you may be required to attend periodic reviews or hearings in order to show that your claim is still valid.
