What happens if I am found to have a “credible fear”?
If you are found to have a "credible fear" of returning to your home country when seeking asylum in Tennessee, the Asylum Officer, U.S. Court of Appeals, or the Board of Immigration Appeals may grant you an interview. During the interview, an immigration judge will consider whether you have a “well-founded fear of persecution” based on race, religion, nationality, political opinion, or membership in a particular social group. If it is determined that you have a “well-founded fear of persecution”, then you may be granted “asylee” status. This will allow you to stay in the United States and have access to certain benefits, such as employment authorization and access to education and medical assistance. As an asylee, you will be allowed to remain in the United States for as long as your asylee status remains valid in accordance with immigration laws and regulations. You may also be able to apply for permanent residence by filing an application with U.S. Citizenship and Immigration Services within one year of being granted asylee status. As an asylee you may also be eligible to apply for a Green Card or Adjustment of Status, which would allow you to become a Lawful Permanent Resident of the United States. It is important to note that asylees are still subject to all of the same laws and regulations as other immigrants, including the requirement that they maintain a valid immigration status. Asylees are expected to follow all federal and state immigration laws and regulations, or face serious consequences.
