What is “asylee eligibility”?

Asylee eligibility refers to the conditions and criteria that must be met in order for an individual to qualify for asylum in Virginia. An individual seeking asylum must prove that they are a refugee, defined as a person who has a “well-founded fear of persecution in their home country.” They must also prove that they are unable or unwilling to return to their home country based on fears of persecution on the basis of race, religion, national origin, political opinion, or membership in a particular social group. In addition to proving that an individual is a refugee, asylee eligibility also requires that an individual demonstrate that they are not inadmissible to the United States on the basis of certain factors. An individual may be inadmissible on the basis of security, criminal activity, immigration violations, health-related issues, or financial considerations. The final criteria for asylee eligibility involves the “Credible Fear Interview” which must be conducted by an asylum officer. During this interview, the asylum-seeker must demonstrate that they have a genuine fear of persecution in their home country, or fear that they will be subjected to torture, cruel or inhumane treatment, or death in their home country. Once all of these conditions have been met, an individual may be eligible to receive asylum in Virginia. In order to qualify for asylum, however, they must demonstrate that they qualify for one of the five categories of refugee status, including persecution based on race, religion, nationality, political opinion, or membership in a particular social group.
