What is “cancellation of removal”?

Cancellation of Removal is a form of immigration relief available in the state of Florida. It is available to certain nonresident aliens who have been present in the United States for a period of at least 10 years and can demonstrate that their removal would result in “exceptional and extremely unusual hardship” to their family member(s) who are U.S. citizens, lawful permanent residents, or nonresident aliens. Cancellation of removal may help individuals who are placed in removal proceedings and are facing the possibility of deportation to remain in the United States. Eligibility is based on certain criteria, such as continuous physical presence in the US for at least 10 years, good moral character, no felony convictions, and non-involvement in certain criminal activities. An individual may qualify for cancellation of removal if they can show an immigration judge that deporting them would cause undue hardship to their US citizen or lawful permanent resident family members. This could include factors such as a family member with serious health issues, a single parent with a disabled child, or a family member who would have difficulty finding employment in the home country. To receive cancellation of removal, the individual must provide evidence to an Immigration Judge that they meet all the requirements for cancellation of removal. If the Immigration Judge approves the application, it means that the individual is allowed to remain in the United States and may even be eligible for a green card.
