What is the difference between a “refugee” and an “asylee”?

The terms “refugee” and “asylee” may be used interchangeably, but they are not the same thing under the law. In the state of Delaware, a refugee is a person who is located outside of the United States and is unable or unwilling to return to their home country due to persecution or a fear of persecution based on their race, religion, nationality, membership in a particular social group, or political opinion. An asylee is an individual who is already located within the United States and is unable or unwilling to return to their home country because they fear persecution or harm due to any of the same grounds as refugees. Asylees can apply for asylum regardless of their immigration status or whether or not they entered the U.S. with valid documents. The difference between a refugee and an asylee is their respective locations. A refugee is generally located outside of the United States, while an asylee is already located within the United States. Both are granted the same protection from persecution, however, an asylee must apply for asylum from within the United States, while a refugee can apply for protection from abroad with the assistance of the United Nations High Commissioner for Refugees.
