What is the process for applying for an employment-based visa?

In Virginia, an individual can apply for an employment-based visa in order to work in the United States. The process begins with the employer initiating the application by filing a petition with the United States Citizenship and Immigration Services (USCIS). The employer must demonstrate to the USCIS that the position is one which requires specialized knowledge and experience, and has to meet other criteria as well. The applicant must then complete the application forms, providing the USCIS with the necessary documentation such as resumes, transcripts, letters of recommendation, and any other proof that is needed to support the application. Additionally, if the position is for a high-skilled job, the applicant must also submit evidence of their education, training, and/or experience. Once the application is approved, the applicant must schedule an interview at the US Embassy or Consulate with the necessary documentation. During the interview, the U.S. officials will assess the applicant’s qualifications and background, and determine whether or not they meet the requirements for the visa. Once approved, the applicant must pay all necessary fees, and receive their Employment-Based Visa. This visa will allow the individual to enter the United States and work in their approved job. The Employment-Based Visa is valid for a period of two to five years and can be renewed as needed.
